2. Cases of assault, or assault and battery, not charged to have been committed riotously, or upon any public officer in the execution of his duty, or with intent to commit any other offense; also to try any and all persons charged with carrying arms of any kind secretly on or about their persons, or of haying on or about their person any dirk, pistol or other arm or weapon, except a common pocket-knife.
